CHANTILLY HIGHLANDS HOMES ASSOCIATION POLICY RESOLUTION NO. 12-002
(Procedures Related to the Mowing of Gas Pipelines)
WHEREAS, several parcels of property in the Chantilly Highlands development contain gas pipelines on land owned by Chantilly Highlands homeowners association with an easement provided to the pipeline owner;
WHEREAS, the pipeline easement on these parcels includes restrictions on the type of activities that can occur on the property and how the land maybe used and the pipeline owner mows the
property frequently enough to prevent the growth of trees, approximately twice a year;
WHEREAS, the Chantilly Highlands Homeowners Association (CHHA) does not have an obligation to mow this property, nor is it financially feasible for CHHA to maintain all of the pipeline property in the same manner as common ground parcels; and
WHEREAS, homeowners with property next to the pipeline may choose to mow that property on a more frequent basis than the pipeline owner does.
NOW, THEREFORE, BE IT RESOLVED THAT the Board adopts the following policy:
In order to maintain the appearance of the community CHHA will have portions of those parcels subject to the pipeline easement mowed on the same basis as common grounds if:
a) The property is within approximately 50 feet of roads including Kinross Circle, Stoneheather
Drive and McLearen Road,
b) The property is visible from those roads, and
c) Homeowners adjacent to those properties elect not to mow the property on a regular basis.
This policy resolution shall become effective on October 31, 2012.
